Man alleges Capital One harassed him over an account he didn't open

ORLANDO – An Orange County man alleges he is being harassed over a credit card debt for a card he did not apply for.

Lorenzo Turner filed a complaint on Sept. 6 in the U.S. District Court for the Middle District of Florida, Orlando Division against Capital One Bank (USA) National Association citing the Federal Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that between October 2015 and May, he suffered damage from receiving several collection calls on his cellular telephone for a credit card debt. The suit states the plaintiff never applied for a credit card from the defendant and contacted the defendant's fraud department. The plaintiff holds Capital One Bank (USA) National Association responsible because the defendant allegedly continued to harass the plaintiff by calling using an automatic telephone dialing system.

The plaintiff requests a trial by jury and seeks statutory damages, punitive damages, actual damages, interest, all legal fees and any other relief as the court deems just. He is represented by Jared M. Lee of Morgan & Morgan, Tampa PA in Orlando.
