Three Miami-Dade businesses alleged to have not paid employees overtime wages

MIAMI – Three Miami-Dade County businesses are facing a lawsuit from the U.S. Secretary of Labor over allegations they did not pay their employees overtime.

U.S. Secretary of Labor Thomas E. Perez filed a complaint on Sept. 1 in the U.S. District Court for the Southern District of Florida, Miami Division against Digital Medical Imaging LLC, Center for Diagnostic Imaging LTD, Comprehensive Breast Care Centers Inc., German Fraynd and Joseph Osemberg citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that since April 2013, the defendants allegedly failed to pay their employees any overtime premiums at a rate of time-and-one-half of their regular rate of pay. The plaintiff also alleges the defendants failed to keep and make accurate time records of their employees.

The plaintiff seeks permanently enjoin the defendants and awarding back wages and liquidated damages in an equal amount to their employees, all legal fees and any other relief as the court deems just. He is represented by Yasmin K. Yanthis-Bailey of Department of Labor in Atlanta.
