Woman alleges she injured leg on zip-line excursion during cruise

MIAMI – A Texas woman has filed a suit against a cruise line and a tour operator over allegations she was injured while on a zip-line excursion.

Alyda R. Chimene filed a complaint on Sept. 1 in the U.S. District Court for the Southern District of Florida, Miami Division against Royal Caribbean Cruises LTD and MC Tours alleging negligence.

According to the complaint, the plaintiff alleges that on Sept. 3, 2015, she was on a Caribe Zip Line excursion while on a cruise with the defendant. As she approached the platform towards the end of a zip-line ride, the suit states she violently struck her legs onto the platform that ripped skin off, exposing bone, tendons and muscle exposed. She alleges the incident caused her to suffer bodily injury, pain and suffering, disability, mental anguish, loss of capacity for the enjoyment of life, expense of hospitalization, surgery, disfiguring scars and loss of earnings as a result of the incident during an excursion offered by the defendants. 

The plaintiff holds Royal Caribbean Cruises LTD and MC Tours responsible because the defendants allegedly failed to operate the zip-line excursion in a safe manner, failed to inspect/maintain safe equipment and failed to provide adequate warnings of the dangerous conditions of the excursion.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages suffered as a result of the alleged accident with all taxable court costs and prejudgment interest. She is represented by Keith S. Brais, Richard D. Rusak and Julieth A. Fresco of Brais Brais Rusak in Miami.
