McKennycare allegedly failed to pay former employee overtime

FORT MYERS — A scheduler has filed suit against her former employer for alleged unpaid wages.

Jessica Rivera filed a complaint on July 19 in U.S. District Court for the Middle District of Florida, Fort Myers Division, against McKennycare LLC, alleging that the Florida corporation failed to act in good faith.

According to the complaint, the plaintiff alleges that she was employed by the defendant as a scheduler and worked between 60 to 80 hours per week without receiving overtime compensation, even though the plaintiff purportedly was a non-exempt employee and supposedly should have received payment for all hours worked. 

The plaintiff holds McKennycare LLC responsible because the defendant allegedly failed to allow the plaintiff to execute primary job duties, failed to pay the plaintiff the standard rate of pay and failed to pay overtime wages.

The plaintiff requests a trial by jury and seeks judgment in its favor, costs of litigation, interest and other relief as the court deems proper. She is represented by Benjamin Yormak of Yormak Employment and Disability Law in Bonita Springs.
