Nursing assistant claims she allegedly was never paid overtime wages

MIAMI — A nursing assistant has filed suit against the estate of her previous client for allegedly failing to pay her overtime wages.

Panceta C. White filed a complaint Aug. 30 in U.S. District Court for the Southern District of Florida, Miami Division, against Stephen Carr Davis, as personal representative of the estate of Cynthia D. Carr, alleging that the representative of her former employer failed to fairly compensate the plaintiff in her duties as a nursing assistant.

According to the complaint, the plaintiff alleges that between 2012 and June 2016, she worked for more than 40 hours per week without being paid any overtime compensation. The plaintiff holds Stephen Carr Davis, as personal representative of the estate of Cynthia D. Carr, responsible because the defendant allegedly failed to pay any overtime premium to the plaintiff for hours worked that exceeded 40 per week.

The plaintiff requests a trial by jury and seeks overtime damages, liquidated damages, all legal fees and any other relief as the court deems appropriate. She is represented by Noah E. Storch and Richard Celler of Richard Celler Legal P.A. in Davie.
