Former JFK Medical Center employee claims she is owed thousands for answering calls

MIAMI – A former medical center employee alleges she is owed more than $14,000 in overtime wages for answering phone calls off-the-clock.

Marian Mirsky filed a complaint on Aug. 25 in the U.S. District Court for the Southern District of Florida against JFK Medical Center Limited Partnership, doing business as JFK Medical Center, alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between September 2014 and August 2015, she worked for more than 40 hours per week without being paid any overtime compensation for answering phone calls off-the-clock. She alleges these calls for the period mentioned totaled more than 297 hours, and believes she is owed $14,648.55 in unpaid overtime for taking these calls.

The plaintiff requests a trial by jury and seeks all damages plus liquidated damages, interest, legal fees and any other relief as the court deems just. She is represented by Chad E. Levy of Law Offices of Levy & Levy PA in Fort Lauderdale.
