Sunshine Food Mart alleged to sell counterfeit Spy Optic sunglasses

ORLANDO – A Carlsbad, California company alleges a gas station in Satellite Beach is selling counterfeit versions of its sunglasses.

Spy Optic Inc. filed a complaint on Aug. 25 in the U.S. District Court for the Middle District of Florida, Orlando Division against Satelite Investments LLC, doing business as Sunshine Food Mart #0220, and Does 1-10 alleging trademark infringement.

According to the complaint, the plaintiff alleges that it suffered damages to its business from having its trademark used on counterfeit products, which it claims causes confusion among consumers. The plaintiff holds Satelite Investments LLC and Does 1-10 responsible because the defendant allegedly distributed counterfeit sunglasses bearing plaintiff's trademark.

The plaintiff requests a trial by jury and seeks permanent injunctive relief against the defendant, all damages, award all profits to plaintiff, statutory damages, interest, all legal fees and any other relief as the court deems just. It is represented by Stephen Gaffigan of Stephen M. Gaffigan PA in Fort Lauderdale.
