Parent claims child was injured by stairs on Disney cruise

ORLANDO – A parent alleges a child was injured on a cruise ship because of a raised portion of a stair, which caused the child to catch her shoe and fall.

Martha Lynch, on behalf of her minor child B.L., filed a complaint on Aug. 17 in the U.S. District Court for the Middle District of Florida, Orlando Division against Magical Cruise Co., doing business as Disney Cruise Line, alleging negligence.

According to the complaint, the plaintiff alleges that on Aug. 25, 2015, her minor child B.L. was injured on the theater stairs aboard defendant's vessel. As a direct result, plaintiff's child allegedly suffered physical and mental anguish, disability, loss of capacity for the enjoyment of life and incurred medical expenses. The plaintiff holds Magical Cruise Co. responsible because the defendant allegedly failed to inspect and maintain premises and failed to warn passengers of hazardous areas.

The plaintiff requests a trial by jury and seeks judgment for the stated damages, interest, costs of suit and other relief that may be justly entitled. She is represented by Frank D. Butler and James S. Curtis of Frank D. Butler PA in Pinellas Park.
