Financial Recovery Services Inc. accused of using misleading statements in letter

MIAMI – A Deerfield Beach man claims a debt collector used misleading and false statements in an attempt to collect an alleged debt.

Duane Gainer filed a complaint on Aug. 10 in the U.S. District Court for the Southern District of Florida against Financial Recovery Services Inc. alleging that the debt collector violated the Fair Debt Collections Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that on Oct. 12, 2015, he received a collection letter from the defendant that did not indicate how much of the current debt is interest and how much is principal and other misleading statements.

The plaintiff holds Financial Recovery Services Inc. responsible because the defendant's collection efforts allegedly violated the FDCPA and the FCCPA.

The plaintiff requests a trial by jury and seeks judgment against defendant, damages, attorney's fees, costs of suit and other relief as the court may deem just. He is represented by Michael Jay Ringelheim of RC Law Group PLLC in Hackensack, New Jersey.
