An overseas corporation claims retailer allegedly sold counterfeit water pipes

MIAMI — A German corporation has filed suit against a retailer for allegedly selling counterfeit water pipes bearing the corporation's trademark.

Roor filed a complaint on Aug. 9 in U.S. District Court for the Southern District of Florida against Great Ocean View Trading LLC, doing business as Tobacco World, alleging that the retailer violated the Lanham Act.

According to the complaint, the plaintiff alleges that ROOR discovered the defendant was allegedly selling a replica of its water pipe products bearing the same marks that were associated with the company, which was granted the trademark by the U.S. Patent and Trademark Office since Sept. 1, 2009. The defendant allegedly caused damage to the trademark and also to the Roor name by selling inferior products and gained profits from the trademark. The plaintiff holds Great Ocean View Trading LLC responsible because the defendant allegedly was not an authorized seller, sold counterfeit products and gained profit from deceiving consumers.

The plaintiff requests a trial by jury and seeks judgment against the defendant, to be awarded an accounting for profits, damages, attorney's fees and costs, and any further relief as the court deems appropriate.
