Essentia Natural Memory Foam Inc. accused of not paying overtime

MIAMI – An employee alleges he was not paid overtime wages by a company that manufactures and sells mattresses.

Nicholas Peter Joslyn filed a complaint on Aug. 14 in the U.S. District Court for the Southern District of Florida against Essentia Natural Memory Foam Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours without being paid any overtime wages or the legal minimum wage. The plaintiff holds Essentia Natural Memory Foam Inc. responsible because the defendant allegedly failed to pay plaintiff any overtime premium at a rate of time-and-one-half for hours worked that exceeds 40 per week.

The plaintiff requests a trial by jury and seeks judgment against the defendant plus all legal fees and any other relief as this court deems just. He is represented by Elliot Kozolchyk of Koz Law PA in Fort Lauderdale.
