Former employee claims he was shorted overtime pay by Fitzgerald's of Pasco

CLEARWATER — A man has filed a claim against his former employer, Fitzgerald's of Pasco Inc., alleging he wasn't paid for overtime hours he worked.

David Thompson filed a complaint on Aug. 9 in the Sixth Judicial Circuit Court for Pasco County, Florida Civil Division, against Fitzgerald's of Pasco Inc., alleging that the former employer intentionally violated the Fair Labor Standards Act by failing to compensate for overtime hours.

According to the complaint, the plaintiff alleges that from Oct. 6, 2013, to June 2, 2015, he was employed by the defendant and was paid on an hourly basis. The plaintiff alleges that throughout his employment, he was not compensated in excess of the 40 hours per week he was required to work as a result of defendant's acts. The plaintiff alleges he had suffered damages and incurred/will incur costs and attorneys' fees. The plaintiff holds Fitzgerald's of Pasco Inc. responsible because the defendant allegedly failed to pay plaintiff the required overtime pay.

The plaintiff requests a trial by jury and seeks judgment against the defendant, overtime compensation, liquidated damages, interest, attorneys' fees and costs, cessation of unlawful pay policy and other relief as the court may deem appropriate. He is represented by Wolfgang M. Florin, Christopher D. Gray, Lindsey C. Kofoed and Robin M. Orosz of Florin Roebig PA in Palm Harbor.
