Acute Patient Care Inc. accused of not paying overtime, filing false tax reports

ORLANDO – A Kissimmee acute patient care facility is accused of not paying a nursing assistant overtime wages.

Marisol Ramos filed a complaint on Aug. 11 in the U.S. District Court for the Middle District of Florida, Orlando Division against Acute Patient Care Inc., Ajaz Afzal, Ivette Ortiz and Rachel Houser alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between January 2002 and January, she worked for more than 40 hours without being paid any overtime wages. The plaintiff holds Acute Patient Care Inc., Afzal, Ortiz and Houser responsible because the defendants allegedly only paid plaintiff at her normal hourly rate for overtime hours worked, paid her in cash for overtime hours, and filed false tax papers reporting what was paid to the plaintiff.

The plaintiff requests a trial by jury and seeks damages of $5,000, all legal fees and any other relief as the court deems just. She is represented by Luis A. Cabassa of Wenzel Fenton Cabassa PA in Tampa.
