Tennessee company files suit against United Water Restoration Group over alleged trademark infringement

Trademark 02

ORLANDO — A Tennessee company has filed a claim against United Water Restoration Group Inc., Endre Banfi and Zoltan Kurucz for alleged trademark infringement.

Servpro Intellectual Property Inc. and Servpro Industries Inc. jointly filed a complaint on Aug. 11 in U.S. District Court for the Middle District of Florida, Orlando Division, against the defendants, alleging that they used the "Servpro" mark on their websites.

According to the complaint, the plaintiffs allege that Servpro Intellectual Property Inc. and Servpro Industries Inc. have suffered damages as the result of the trademark Servpro being used by the defendants. The plaintiffs hold United Water Restoration Group, Inc., Endre Banfi and Zoltan Kurucz responsible because the defendants allegedly used the Servpro mark, which caused confusion among consumers.

The plaintiffs request a trial by jury and seek injunctive relief against the defendant from further infringing on the plaintiffs' trademark, award damages and profits to plaintiff, multiplied damages and any other relief as the court deems appropriate. The plaintiffs are represented by Richard W. Smith of Fisher Rushmer, P.A. in Orlando.
