Former employees file suit against Nuterra Management, Legomatic Construction

TAMPA — A former employee has filed a class-action lawsuit against joint employers Nuterra Management LLC and Legomatic Construction LLC for alleged unpaid wages.

Miguel Rafael filed a complaint on his own behalf and on behalf of others similarly situated on Aug. 8 in the Tampa Division of the Middle District of Florida against the defendants, alleging that they violated the Fair Labor Standards Act .

According to the complaint, the plaintiffs allege that they routinely worked overtime as hourly laborers, but were not compensated for excess hours at the correct rate As a result of the defendants' unlawful acts, the plaintiff and those similarly situated to him claim to have suffered damages plus incurred attorney's fees and costs. The plaintiffs hold Nuterra Management LLC and Legomatic Construction LLC responsible because the defendants allegedly failed, refused and/or neglected to keep accurate time records and failed to pay the plaintiffs with a regular rate of pay and premium wages for hours in excess of 40 per week.

The plaintiffs request a trial by jury and seek judgment against the defendants, reimbursement of an amount equal to the loss of wages and liquidated damages, costs and attorney's fees and other relief that the court deems just and proper.
