Jimmy John's driver alleges she was not paid minimum wage

FORT MYERS – A Collier County woman alleges she was terminated from her job as a delivery driver for a sandwich company after she complained about not being paid a minimum wage.

Beverly Adkins filed a complaint on Aug. 8 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Jimmy John's of Estero Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between May 2015 and February, she was paid at the tipped minimum wage even though she routinely performed nontipped work. The plaintiff holds Jimmy John's of Estero Inc. responsible because the defendant allegedly retaliated against plaintiff and terminated her when she complained about the unfair practice of not paying the legal minimum wage.

The plaintiff requests a trial by jury and seeks actual damages, liquidated damages, all legal fees and any other relief as this court deems just. She is represented by Angeli Murthy of Morgan & Morgan PA in Plantation.
