BUNNELL – An employee has filed a class-action lawsuit against a pharmacy chain and its local store alleging she was retaliated against for speaking to human resources about not being paid overtime.
Alison Heller filed a complaint on behalf of all others similarly situated on Aug. 8 in the 7th Judicial Circuit Court for Flagler County against
CVS Pharmacy Inc. and CVS 3249 FL LLC alleging violation of the Fair Labor Standards Act and other counts.
According to the complaint, the plaintiff alleges that between January 2010 to the present, she worked for more than 40 hours per week without being paid any overtime wages. She also alleges that the defendants retaliated against her for complaining regarding the unlawful practice by changing her schedule and forcing her to work with the manager she had filed a complaint against. The plaintiff holds CVS Pharmacy Inc. and CVS 3249 FL LLC responsible because the defendants allegedly failed to pay plaintiff any overtime premium for hours worked that exceeds 40 per week.
The plaintiff requests a trial by jury and seeks unpaid wages, all legal fees and interest, and any other relief as the court deems just. She is represented by Jay P. Lechner and Jason M. Melton of Whittel & Melton LLC in St. Petersburg.
