Consumer files suit against Citibank (South Dakota) NA over calls

TAMPA – A Sarasota County woman alleges a debt collector continued to contact her despite her request to contact her lawyer.

Caitlin Porcelli filed a complaint on Aug. 8 in the Tampa Division of the Middle District of Florida against Citibank (South Dakota) NA alleging violation of the Florida Consumer Collection Practices Act and the Telephone Consumer Protection Act.

According to the complaint, the defendant has attempted to call the plaintiff in an attempt to collect an alleged debt on a Citi Simplicity Card. The plaintiff alleges that in March, she sent a fax to the defendant instructing it to send any further communication to her lawyer and revoked permission to contact her. The plaintiff holds Citibank (South Dakota) N.A. responsible because the defendant allegedly continued to contact the plaintiff using an automatic dialing system.

The plaintiff requests a trial by jury and seeks statutory damages in the amount of $500 for each and every violation, increase the amount of the award to three times the amount available, and any other relief as the court deems just. She is represented by Christopher W. Boss of Boss Law in St. Petersburg.
