German corporation files claim against Amex 1989 Inc. for alleged trademark infringement

MIAMI — A German corporation has filed suit against Amex 1989 Inc. regarding an alleged trademark infringement for its glass water pipes.

ROOR filed a complaint on Aug. 8 in the U.S. District Court for the Southern District of Florida against Amex 1989 Inc., alleging that the Florida corporation sells products that bear the plaintiff's trademark and citing alleged unfair competition.

According to the complaint, the plaintiff alleges that ROOR has suffered damages to the business as the result of its trademark being used on counterfeit copies of its products. The plaintiff holds Amex 1989 Inc. responsible because the defendant allegedly used the plaintiff's trademark on their products to deceive consumers into buying them.

The plaintiff seeks judgment against the defendant for damages, award profits and damages to the plaintiff, all legal fees and any other relief as the court deems appropriate. The plaintiff is represented by Anthony J. Badway of The Ticktin Law Group, PLLC in Deerfield Beach.
