Woman seeks coverage from insurance after accident with underinsured motorist

LAKE CITY – A motorist has filed suit against her insurance company seeking benefits under its uninsured/underinsured coverage policy.

Briana Toledo filed the complaint on Aug. 5 in the 3rd Judicial Circuit Court for Columbia County against USAA Casualty Insurance Co.

According to the complaint, the plaintiff alleges that on July 9, 2014, while she was driving in Live Oak, a vehicle of an underinsured motorist collided into her vehicle, causing her to suffer from bodily injury, physical pain, mental anguish, medical expenses and aggravation of a previously existing condition. She alleges the injuries resulted in damages that exceeded the underinsured motorist's bodily injury coverage. The plaintiff holds USAA Casualty Insurance Co. responsible because the defendant allegedly issued a policy of automobile liability insurance to plaintiff, in full force and effect, which protected her from uninsured/underinsured motorists and entitled her to full benefits under the policy.

The plaintiff requests a trial by jury and seeks judgment against the defendant for an amount that exceeds $15,000 and costs of this action. She is represented by Thomas T. Demas of Thomas T. Demas PA in Lake City.
