Busser alleges he was only paid share of tips at La Baguette

MIAMI – A Miami Beach restaurant is accused of not paying a busser an hourly wage or overtime wages.

Vincenzo Lamedica filed a complaint on Aug. 3 in the U.S. District Court for the Southern District of Florida against Ocean Drive Restaurant LB LLC, doing business as La Baguette, and Anselmo Hernandez alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between December, 2014 and March, he worked without being paid an hourly wage and any overtime compensation. The plaintiff holds Ocean Drive Restaurant LB LLC and Hernandez responsible because the defendants allegedly only paid the plaintiff a share of the tips collected and did not pay overtime premiums.

The plaintiff requests a trial by jury and seeks payment of all hours at the full minimum wage, all overtime hours at the full overtime wage, attorney's fees, all legal fees and any other relief as this court deems just. He is represented by Robert W. Brock II of Law Office of Lowell J. Kuvin in Miami.
