Suit filed against Insys Therapeutics alleging wrongful death from drug's use

JACKSONVILLE – A Jacksonville man has filed a wrongful death suit against a pharmaceutical company alleging a drug lead to his wife's death.

Robert N. Markland, as the personal representative of the estate of Carolyn S. Markland, filed a complaint on Aug. 4 in the 4th Judicial Circuit Court - Duval County against Insys Therapeutics Inc. alleging wrongful death and products liability.

According to the complaint, the suit states Carolyn S. Markland was prescribed Subsys Fentanyl and that her July 3, 2014, death was ruled as caused by drug toxicity. The plaintiff holds Insys Therapeutics Inc. responsible because the defendant allegedly negligently and unlawfully marketed the drug as a way to treat chronic pain problems when this off-label use was not approved by the Food and Drug Administration. The drug is intended for use by cancer patients for breakthrough pain, the suit states.

The plaintiff requests a trial by jury and seeks judgment against the defendant plus all legal fees and all damages. He is represented by C. Wayne Alford and Charles W. Alford Jr. of Alford Law Group PA in Jacksonville.
