Bayview Loan Servicing accused of sending misleading letter to collect alleged debt

MIAMI – A consumer has filed a class-action lawsuit against a debt collector claiming it mailed a misleading letter to her in regards to collect an alleged debt.

Laurie Gough filed a complaint on behalf of all others similarly situated on Aug. 2 in the U.S. District Court for the Southern District of Florida against Bayview Loan Servicing LLC alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff was contacted by the defendant in December 2015 in order to collect an alleged debt. The plaintiff holds Bayview Loan Servicing LLC responsible because the defendant's letter alleged had a writing requirement to dispute the debt, which is in violation of the FDCPA

The plaintiff seeks award of statutory damages, all legal fees and interest, and any other relief as the court deems just. She is represented by Leo W. Desmond and Sovathary K. Jacobson of Desmond Law Firm PC in Vero Beach.
