Consumer alleges Zwicker & Associates' letter violated debt collection laws

MIAMI – An Indian River County consumer has filed a class-action lawsuit against a debt collector over allegations of misrepresentation in debt collection.

Richard Leonard filed a complaint on behalf of all others similarly situated on Aug. 2 in the U.S. District Court for the Southern District of Florida against Zwicker & Associates PC alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges the defendant sent him a letter regarding an alleged debt owed to American Express Centurion Bank. The plaintiff alleges the defendant violated the FDCPA because the letter falsely and misleadingly identified American Express as the debt holder, which could apply to numerous different entities.

The plaintiff seeks award statutory damages to plaintiff, all legal fees and interest and any other relief as the court deems just. He is represented by Leo W. Desmond and Sovathary K. Jacobson of Desmond Law Firm PC in Vero Beach.
