Suit filed against Marco Polo Beach Resort by man alleging he was injured in fall

MIAMI – A guest has filed suit against a Golden Beach hotel alleging he was injured by hazardous conditions in his room.

Herbert Sherwood filed a complaint on Aug. 1 in the U.S. District Court for the Southern District of Florida against Aventura Beach Associates LTD, doing business as Marco Polo Beach Resort, alleging negligence.

According to the complaint, the plaintiff alleges that on April 28, 2015, he sustained physical injuries to his knee and right arm when he slipped due to water on the floor. The plaintiff holds Aventura Beach Associates LTD responsible because the defendant allegedly failed to properly maintain the air conditioning unit on the ceiling on the rooms, which caused the puddle of water on the floor.

The plaintiff requests a trial by jury and seeks judgment against the defendant for an amount exceeding the jurisdictional minimums of this court, compensatory damages, interest, legal fees and any other relief as this court deems just.
