Woman alleges LINA wrongfully denied disability benefits

TAMPA – A Pasco County woman has filed suit against her insurer alleging it wrongfully denied her disability benefits.

Silvana Momani filed a complaint on July 28 in the Tampa Division for the Middle District of Florida against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in January 2015, she became disabled and applied for disability benefits but was denied that September by the defendant. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly upheld its decision to deny plaintiff's disability benefits despite having adequate medical records to support plaintiff's claim.

The plaintiff seeks all plan benefits owing, interest, all legal fees and any other relief as the court deems just. She is represented by Nick A. Ortiz of Ortiz Law Firm in Pensacola.
