PENSACOLA – A man alleges paperwork he needed to file an appeal of the termination of his disability benefits was not provided as requested.
Lonnie Harris filed a complaint on July 29 in the U.S. District Court for the Northern District of Florida, Pensacola Division against
Hartford Life and Accident Insurance Co. and Denali Inc.
alleging violation of the Employee Retirement Income Securities Act.
According to the complaint, the plaintiff alleges that in April 13, 2013, he became disabled was receiving long-term disability benefits from the defendants until the benefits were terminated in February. The plaintiff holds Hartford Life and Accident Insurance Co. and Denali Inc. responsible because the defendants allegedly did not provide documents the plaintiff requested to file an appeal by deadline so the plaintiff could prepare an appeal of the termination.
The plaintiff seeks damages in the form of monetary penalties of up to $110 per day for each day from each defendant, all legal fees and any other relief as the court deems just. He is represented by Stephanie A. Taylor of Taylor, Warren & Weidner PA in Pensacola.
