PENSACOLA – A man has filed suit against the operator of wine and liquor stores alleging he was not paid overtime wages or a proper minimum wage.
Michael O'Shea filed a complaint on July 1 in the U.S. District Court for the Northern District of Florida, Pensacola Division against
Atit Inc. and Manoj Patel
alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he worked for more than 40 hours without being paid the legal minimum wage as well as proper overtime premium. The plaintiff holds Atit Inc. and Patel responsible because the defendants allegedly failed to pay plaintiff any overtime wages at a rate of one-and-one-half for all hours worked in excess of 40 hour per week and also did not pay the federal minimum wage.
The plaintiff requests a trial by jury and seeks actual and compensatory damages, unpaid overtime compensation, liquidated damages, all legal fees and any other relief as the court deems just.
