Man claims bank reported debt on credit card opened without his knowledge

ORLANDO – An Orlando man alleges a credit card was opened in his name without his knowledge after applying for a club membership.

Larry Rumbough filed a complaint on July 21 in the U.S. District Court for the Middle District of Florida, Orlando Division against Comenity Capital Bank, BJ's Wholesale Club Inc., Equifax Information Services LLC, Experian Information Solutions Inc., Trans Union LLC and Innovis Data Solutions Inc. alleging violation of the Fair Credit Reporting Act and the Fair Debt Collection Act.

According to the complaint, the plaintiff was approved for membership to BJ's Wholesale in December 2015. The suit states that credit card for Comenity Capital Bank was opened in his name without his permission or knowledge and that Comenity has since tried to collect a debt from him.

The plaintiff alleges that he suffered damages as a result of inaccurate credit report with the debt being sent to third parties by Comenity. The plaintiff holds Comenity Capital Bank, BJ's Wholesale Club Inc., Equifax Information Services LLC, Experian Information Solutions Inc., Trans Union LLC and Innovis Data Solutions Inc. responsible because the defendants allegedly failed and refused to correct plaintiff's credit statement despite plaintiff's request or do a proper investigation.

The plaintiff requests a trial by jury and seeks actual and statutory damages, punitive damages, all legal fees and any other relief as the court deems just. He is representing himself.
