MIAMI – A cast diver/swimmer of the Allure of the Seas cruise ship has filed suit against his employer alleging he was injured during a performance.

David J. Magaro filed a complaint on July 20 in the U.S. District Court for the Southern District of Florida against Royal Caribbean Cruises LTD alleging negligence and unseaworthiness and other counts.

According to the complaint, the plaintiff alleges that on Aug. 2, 2014, he suffered serious injuries, including a fracture of the right femur and other physical injuries, as the result of diving into less than 1 meter of water from a height of 10 meters. The plaintiff holds Royal Caribbean Cruises LTD responsible because the defendant allegedly failed to properly control the height of the lift to make sure that the pool water level was reasonable safe for plaintiff to dive into.

The plaintiff requests a trial by jury and seeks all damages, medical expenses, judgment against the defendant in excess of the minimum jurisdictional limits of this court plus interest, all legal fees and any other relief as this court deems just. He is represented by Carol L. Finklehoffe of Leesfield Scolaro PA in Miami.
