S.A.S. Jean Cassegrain, Longchamp USA Inc. file suit claiming trademark infringement

MIAMI – A manufacturer of bags and wallets and its distributor have filed a suit against several online domain names alleging the sale of counterfeit goods.

S.A.S. Jean Cassegrain and Longchamp USA Inc. filed a complaint on July 15 in the U.S. District Court for the Southern District of Florida against cheaplongchampoutlet.com, cheaplongchamps.com, longchampoutletsshop.com, et al., alleging trademark infringement.

According to the complaint, the plaintiffs allege that they suffered damages to their business. The plaintiffs holds cheaplongchampoutlet.com, cheaplongchamps.com, longchampoutletsshop.com, et al., responsible because the defendants allegedly promoted and distributed confusingly similar products that contain plaintiff's marks online.

The plaintiffs seek to enjoin the defendants, permanent injunction against the defendants, pay plaintiff all profits and damages derived from the infringing acts, $2 million as statutory damages per each counterfeit trademark used, $100,000 as statutory damages per cybersquatted domain name used, all legal fees and interest, and any other relief as the court deems just. They are represented by Stephen M. Gaffigan, Virgilio Gigante and T. Raquel Rodriguez-Albizu of Stephen M. Gaffigan PA in Fort Lauderdale.
