MIAMI – A former Lowe's employee alleges her long-term disability benefits were wrongfully terminated.
Linda Camach filed a complaint on July 11 in the U.S. District Court for the Southern District of Florida against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges since September 2013, she has been disabled and was initially paid disability benefits until it was suddenly terminated by the defendant on Dec. 18, 2015. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly denied plaintiff's claim for disability benefits despite plaintiff still being disabled according to the terms of the plan.
The plaintiff seeks payment of disability benefits, reinstatement, declare her right to be paid long-term disability benefits for as long as she remains disabled, all legal fees and interest, and all other relief as the court deems just. She is represented by Victor Pena and Gregory Michael Dell of Attorneys Dell and Schaefer Chartered in Hollywood.
