Garden Apartments Inc. alleged to owe wages to former maintenance worker

MIAMI – A maintenance worker alleges he was not paid any overtime wages while working for his former employer.

Jaime Rafael Benito Rincon filed a complaint on behalf of all others similarly situated on July 6 in the U.S. District Court for the Southern District of Florida against Garden Apartments Inc. and Alexander Abel Daoud alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Dec. 14, 2015, and June 28, he worked an average of 48 hours per week without being paid any overtime wages by the defendants. The plaintiff holds Garden Apartments Inc. and Abel Daoud responsible because the defendants allegedly failed to pay plaintiff any overtime compensation at a rate of time-and-one-half for all hours worked in excess of 40 hours per workweek.

The plaintiff requests a trial by jury and seeks double damages, all wages still owing, all legal fees and any other relief as the court deems just. He is represented by J.H. Zidell of J.H. Zidell PA in Miami Beach.
