MIAMI – Three former employees have filed a class-action lawsuit against a health care center and its owner over allegations that they were not properly paid.

Clara Ivette Coya, Rosalia Hidalgo Zaldivar, Walkiria Maria Perez Lopez filed a complaint on behalf of all others similarly situated on June 21 in the U.S. District Court for the Southern District of Florida against Modelo Health Care Center Inc. and Tulio Quirantes Jr. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that during their employments, they worked for more than 40 hours but were not paid any overtime wages by the defendant. The plaintiffs holds Modelo Health Care Center Inc. and Quirantes Jr. responsible because the defendants allegedly failed to pay overtime compensation of time-and-one-half to plaintiffs for all their hours worked in excess of 40 per workweek as well as failed to pay them the legal minimum wage.

The plaintiffs request a trial by jury and seek double damages, all minimum wages still owing, interest, all legal fees and any other relief as the court deems just. They are represented by J.H. Zidell of J.H. Zidell P.A. in Miami Beach.
