First Advantage Background Services alleged to have inaccurate report on man

TAMPA – A Tarpon Springs man alleges he was denied employment because of an inaccurate consumer report.

Damian A. Patrick filed a complaint on May 23 in the Tampa Division of the Middle District of Florida against First Advantage Background Services Corp., Winn-Dixie Stores Inc., Macy's Inc. and Spartan Staffing LLC alleging violation of the Fair Credit Reporting Act.

According to the complaint, the plaintiff alleges that he suffered damages to his reputation as a result of First Advantage reporting inaccurate statements about his criminal history, which has caused the defendant employers to deny him employment. The plaintiff alleges Winn-Dixie Stores Inc., Macy's Inc. and Spartan Staffing never provided a notice to him of his right to dispute the report.

The plaintiff requests a trial by jury and seeks actual damages, statutory damages, treble damages, punitive damages, all legal fees and any other relief as the court deems just. He is represented by Aaron M. Swift, Gregory H. Lercher and Sara J. Weiss of Leaven Law in St. Petersburg.
