Pinebrook Plaza owner accused of violating ADA

ORLANDO – An individual has filed a suit alleging that the owner of the Pinebrook Plaza in Fort Myers failed to keep the premises easily accessible for persons with disabilities.

Pat Kennedy filed a complaint on May 27 in the U.S. District Court for the Middle District of Florida against Harry M. Lowell citing violations of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that on May 3, she was visiting the property but encountered barriers which she found discriminating. The plaintiff holds Harry M. Lowell responsible because the defendant allegedly failed to comply with the ADA to provide proper accommodations to persons with disabilities.

The plaintiff seeks injunctive relief, order to make the facility readily accessible to disabled persons, all legal fees and any other relief as the court deems just. She is represented by Jeanette E. Albo and Thomas B. Bacon of Thomas B. Bacon PA in Miami and Mount Dora.
