FORT LAUDERDALE – A Broward County woman alleges that a Sunrise business has barriers that restrict access to the disabled.

Frances M. Dale filed a complaint on May 24 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against O'Mac Coin Laundries Inc., doing business as Sunrise Wash Mart LLC, and Gator University Sunrise LLC alleging violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that on May 13, 2016, she visited defendants' facility but was denied full and equal access and full and equal enjoyment of the services, goods and accommodations offered therein. She claims she has suffered legal harm and legal injury and will continue to suffer such harm and injury as a result of the illegal barriers at defendants' property. The plaintiff holds O'Mac Coin Laundries Inc. and Gator University Sunrise LLC responsible because the defendants allegedly failed to provide proper restroom signage, failed to provide restrooms that are accessible to and usable by individuals with disabilities and failed to provide side wall grab bars to transfer safely to the toilet without assistance.

The plaintiff requests a trial by jury and seeks permanent injunction enjoining defendants from continuing their discriminatory practices, ordering defendants to remove physical barriers to access and alter the subject facility and property to make them readily accessible to and useable by individuals with disabilities and award for reasonable attorney’s fees, litigation expenses and costs.
