Dane Construction and Co. Inc. alleges it is owed for work

MIAMI – A Tampa subcontractor alleges it was not completely paid for work on a Broward County construction project.

Dane Construction and Co. Inc. filed a complaint on May 23 in the U.S. District Court for the Southern District of Florida against Travelers Casualty and Surety Co. of America, Liberty Mutual Insurance Co., Federal Insurance Co. and Fidelity and Deposit Co. of Maryland alleging breach of payment bond.

According to the complaint, the plaintiff alleges that it has been damaged under the subcontract agreement in the amount of $123,677.91. The plaintiff holds Travelers Casualty and Surety Co. of America, Liberty Mutual Insurance Co., Federal Insurance Co. and Fidelity and Deposit Co. of Maryland responsible because the defendants allegedly failed and/or refused to pay their obligations despite demands from the plaintiff for work done in 2013.

The plaintiff requests a trial by jury and seeks judgment against defendant for payment of bond claim in the amount of $123,677.91, together with interest, costs, attorneys’ fees, and such further relief as the court deems just and proper.
