Home Encounter 1 accused of not paying overtime wages

TAMPA – A Hillsborough County handyman alleges his former Lutz employer did not pay him overtime wages.

Frank Bienes filed a complaint on May 20 in the Tampa Division of the Middle District of Florida against Home Encounter 1 LLC alleging that the property management company violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for defendant beginning on Sept. 2, 2014, through Aug. 17, 2015, for more than 40 hours per week without receiving overtime premiums for those extra hours performed. The plaintiff holds Home Encounter 1 LLC responsible because the defendant allegedly failed to compensate him at the rate of one-and-one-half of his regular rate for all hours worked in excess of 40 hours per workweek.

The plaintiff requests a trial by jury and seeks declaration that defendant's violation of FLSA was willful, compensation for all damages, attorney's fees and costs and for such further relief as the court deems just and proper. He is represented by Luis A. Cabassa of Wenzel Fenton Cabassa PA in Tampa.
