Drivetime Automotive Group Inc., Bridgecrest Credit Co. accused of phone harassment

FORT MYERS – A Lee County man claims two Arizona companies have harassed him with phone calls over an alleged debt.

Anthony Milana filed a complaint on May 19 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Drivetime Automotive Group Inc., doing business as Drivetime Car Sales Co. LLC, and Bridgecrest Credit Co. LLC alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that since October 2015, he has received more than 50 calls to his cellular telephone from the defendants attempting to collect an auto loan. Despite his revocation of consent, defendants' autodialer calls continued, the suit states. The plaintiff holds Drivetime Automotive Group Inc. and Bridgecrest Credit Co. LLC responsible because the defendant allegedly intentionally harassed and abused him on numerous occasions by calling several times during one day and on back-to-back days. The calls were allegedly made using an automatic telephone dialing system and/or an artificial or pre-recorded voice.

The plaintiff requests a trial by jury and seeks judgment against defendants for statutory damages, punitive damages, actual damages, treble damages, enjoinder from further violations of the law and any other such relief the court may deem just and proper.
