DJ claims Scores Steakhouse did not pay him overtime

JACKSONVILLE – A disc jockey at a gentleman's club alleges he was not properly compensated.

Michael Sexton filed a complaint on May 16 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against Emperors Gentleman's Club Inc., doing business as Scores Steakhouse, and Michael Tokovich alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that during his employment with the defendants from December 2006 through January 2015, he worked for more than 40 hours per week without proper compensation. The plaintiff holds Emperors Gentleman's Club Inc. and Tokovich responsible because the defendants allegedly failed and refused to pay overtime premiums at a rate not less than one-and-one-half of his regular rate for all hours worked in excess of 40 hours in a workweek and failed pay at least the applicable minimum wage for all hours worked.

The plaintiff requests a trial by jury and seeks declaration that defendants' conduct violated the FLSA, judgment against defendants for actual and liquidated damages, attorney's fees, costs and expenses and such other relief deemed proper by the court. He is represented by Michael N. Hanna of Morgan & Morgan PA in Plantation.
