Navient Solutions accused of robocalling

MIAMI – A Florida man alleges a debt collector called more 150 times after he requested it to stop.

Ismael Cedeno filed a complaint on May 17 in the U.S. District Court for the Southern District of Florida against Navient Solutions Inc. alleging violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that from May 2015 through the filing of this complaint, he has received approximately 150 automated calls to his cellular telephone without his prior express permission. The plaintiff holds Navient Solutions Inc. responsible because the defendant allegedly intentionally harassed and abused him on numerous occasions by calling several times during one day, and on back-to-back days and attempted to collect a debt using an automatic telephone dialing system and/or an artificial or pre-recorded voice.

The plaintiff requests a trial by jury and seeks judgment against defendant for statutory damages, punitive damages, actual damages and any other such relief the court may deem just and proper.
