Chanel files suit against alleged counterfeit goods sellers

Trademark 08

MIAMI – A luxury goods manufacturer claims that various sellers are selling counterfeit goods on Amazon.

Chanel Inc. filed a complaint on May 17 in the U.S. District Court for the Southern District of Florida against 007 store, absahomeshop, Akshop, Alif-US09, an a, Anita Regalado, berenger-com, bigdogshow, chaoyingMT, De Pei Li, Dragon Ball 06, Esey ig, fengyizushi, FouTun, Gaa Jeem, et al., citing alleged trademark counterfeiting and infringement and unfair competition.

According to the complaint, the plaintiff alleges that it has suffered and will continue to suffer irreparable injury and damages unless and until a decision is rendered enjoining the defendants from further infringing the Chanel marks. The plaintiff holds the defendants responsible because the defendants allegedly wrongfully reproduced, promoted, advertised, distributed, sold and offered for sale goods bearing counterfeit and confusingly similar imitations of Chanel’s marks and provided false and/or misleading information to the internet-based e-commerce stores.

The plaintiff requests a trial by jury and seeks temporary, preliminary and permanent injunctions enjoining defendants from using Chanel marks, an order requiring defendants to account to and pay Chanel for all profits and damages resulting from defendants’ counterfeiting and infringing, an award for costs and reasonable attorneys’ fees, prejudgment interest and for any further relief as the court may deem just and proper. It is represented by Stephen M. Gaffigan, Virgilio Gigante and T. Raquel Rodriguez-Albizu of Stephen M. Gaffigan PA in Fort Lauderdale.
