Former Tower Optical Corp. files suit for allegedly unpaid overtime

MIAMI – An inside sales agent is suing his former Boynton Beach employer alleging he is owed unpaid wages.

Wayne Demaline filed a complaint on May 5 in the U.S. District Court for the Southern District of Florida against Tower Optical Corp. and Mel D. Kantor alleging that they allegedly violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that during his employment from 2012 to 2015, he regularly worked more than 40 hours per workweek for several weeks without being compensated for any overtime benefits. The plaintiff holds Tower Optical Corp. and Mel D. Kantor responsible because the defendants allegedly failed to pay overtime premiums at a rate of time-and-one-half his hourly rate.

The plaintiff requests a trial by jury and seeks judgment be entered in his favor and against defendant for back overtime payments, liquidated damages, prejudgment interest, reasonable attorneys’ fees and costs of suit and such other and further relief as the court deems just and proper. He is represented by Cathleen Scott of Scott Wagner & Associates PA in Jupiter.
