Couple alleges government wrongfully denied refund for tax overpayment

TAMPA – A Hillsborough County couple alleges they are owed a tax refund for overpayment.

Ralph Santell Jr. and Susan Santell filed a complaint on May 10 in the Tampa Division of the Middle District of Florida against United States of America alleging that the government agency allegedly denied to return overpaid federal income taxes.

According to the complaint, the plaintiffs allege that they overpaid the Internal Revenue Service in additional income taxes in the amount of $59,565 for the 2010 tax year. The plaintiffs hold United States of America responsible because the defendant allegedly erroneously and improperly disallowed a claim for refund of a federal income tax overpayment for the 2010 tax and erroneously and illegally retained additional income taxes.

The plaintiffs request a trial by jury and seek judgment against the defendant in the amount of $59,565 together with interest and for such other and further relief as the court deems just and proper. They are represented by Jaime Austrich of Shumaker, Loop & Kendrick LLP in Tampa.
