Woman claims Guardian Life owes her life insurance proceeds

MIAMI – A Miami-Dade County woman alleges that she is owed life insurance benefits.

Lillian Fernandez filed a complaint on May 6 in the U.S. District Court for the Southern District of Florida, Miami Division against The Guardian Life Insurance Co. of America alleging breach of contract

According to the complaint, the plaintiff alleges that she is the beneficiary to life insurance proceeds pursuant to the policy as a result of the accidental death of her son, Steve Wolmers, in 2014. She alleges she has not received the accidental death life insurance proceeds to which she is entitled. The plaintiff holds The Guardian Life Insurance Co. of America responsible because the defendant allegedly failed and refused to honor its obligations under the policy issued to Wolmers and to plaintiff as the beneficiary to the policy.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages, attorney’s fees, costs, interest and for such other and further relief as the court deems just and proper. She is represented by John P. Murray of The Murray Law Firm PA in Coral Gables and Jon M. Herskowitz of Baron & Herskowitz in Miami.
