MIAMI – A disabled Broward County man alleges a Fort Lauderdale restaurant
discriminated against him by denying access to and full and equal
enjoyment of goods, services and/or accommodations offered at the
Luis Sierra filed a complaint on May 10 in the U.S. District Court for the Southern District of Florida against Orion Venture XII Florida LLC and RRF 7458 LLC, doing business as Denny's 7458,
alleging violation of the Americans with Disabilities Act.
According to the complaint, the plaintiff alleges that on April 26 he personally visited defendants’ facilities but was denied full and equal access to and full and equal enjoyment of the goods, services and amenities within defendant’s facility. The plaintiff holds Orion Venture XII Florida LLC and RRF 7458 LLC responsible because the defendants allegedly failed to provide restrooms that are accessible to and usable by individuals with disabilities.
The plaintiff requests a trial by jury and seeks declaratory relief that defendants' property is in violation of the ADA, an order requiring defendants to alter their facilities to make them accessible to and usable by individuals with disabilities, an order directing defendants to evaluate and neutralize its policies and procedures toward persons with disabilities, attorneys' fees, costs and other expenses and such other and further relief as it may deem necessary, just and proper.
