Woman alleges she is entitled to Sunlife Assurance benefits

JACKSONVILLE – A plan participant alleges the insurance company wrongfully denied her benefits.

Lori Rigotti filed a complaint on May 5 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against Sunlife Assurance Co. of America alleging that the claims administrator allegedly violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she has been damaged for not receiving long-term disability and waiver of premium benefits under the terms of the plan. The suit states that she became entitled to these benefits in July 2015. The plaintiff holds Sunlife Assurance Co. of America responsible because the defendant allegedly denied her application for long-term disability benefits.

The plaintiff requests a trial by jury and seeks judgment against defendant for payment of long-term disability and waiver of premium benefits due and owing under the plan, plus interest, attorney's fees and costs. She is represented by Thomas M. Farrell IV of Farrell Disability Law in Jacksonville.
