FORT MYERS – A reservation specialist has filed a class-action suit against her former Collier County employer, alleging that she was only paid straight time for all hours worked over 40 in a work week.

Robin Fox filed a complaint on behalf of others similarly situated on May 5 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against Naples Florida Vacation Homes LLC and Kristen Jasinski alleging that they allegedly violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that from August 2014 through July 2015, she worked for the defendants for more than 40 hours per work week without proper compensation. She alleges she was paid straight time only. The plaintiff holds Naples Florida Vacation Homes LLC and Jasinski responsible because the defendants allegedly failed and refused to compensate her at the rate of time-and-one-half of her regular rate for each hour worked in excess of 40 hours per week as required by the FLSA and failed to engage in a deliberate process to finalize a settlement agreement.

The plaintiff requests a trial by jury and seeks declaration that defendants' conduct violated the law, compensation for actual and liquidated damages, attorneys' fees and costs and any such other relief that the court may deem appropriate. She is represented by Paul M. Botros of Morgan & Morgan PA in Plantation.
