Life Insurance Co. of America accused of unlawful termination of benefits

MIAMI – A disabled employee is suing a claims administrator alleging her disability benefits were wrongfully terminated.

Thelma Neal filed a complaint on May 2 in the U.S. District Court for the Southern District of Florida, Miami Division against Life Insurance Co. of North America alleging that the claims administrator allegedly violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that, since Nov. 2, 2013, she has not received her benefits under the long-term disability plan when the defendant had previously been paying them. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly breached its fiduciary duties owed to her under ERISA and refused to pay her benefits, ignoring the medical records and clear opinions of her physicians.

The plaintiff requests a trial by jury and seeks unpaid long-term disability benefits plus interest, attorney's fees and costs. She is represented by Edward Philip Dabdoub and Geannina Burgos of Wagar Dabdoub PA in Miami.
